Terms and Conditions of Sale (T&Cs;) for Seasonal Rentals via Terry’s Homes Agency
Agency Information
Terry’s Homes Agency, whose registered office is located at 12 Avenue Maréchal Juin, 06400 Cannes, France,
telephone: +33 6 08 06 91 45, email: terry@terrys-homes.com, is registered with the Cannes Trade and
Companies Register under number 889 678 553. The Agency holds the professional licence for Property
Management and Transactions No. 8303 2021 000 000 007, professional indemnity insurance (MMA) No. 120
137 405, and a financial guarantee provided by GALIAN No. C 120 662 61, securing client funds up to €340,000.
Purpose of the Agreement
The Agency markets, through its website www.terrys-homes.com, accommodation entrusted to it under property
management mandates for furnished seasonal rentals. By accepting these Terms and Conditions of Sale, rental
agreements are concluded with the tenants (hereinafter referred to as “the Client”) and do not fall within the scope
of French Law No. 89-462 of 6 July 1989 relating to primary residence tenancy agreements.
1. Booking Confirmation
To confirm a booking, the Client must:
• Accept the Terms and Conditions of Sale;
• Provide valid identification;
• Complete and sign the online booking form or the rental agreement supplied by the Agency; and
• Pay a deposit equal to 30% of the total rental amount, either by bank transfer to the Agency’s escrow account or
by credit card (STRIPE fees apply: 2.7% for cards issued within the Schengen Area and 3.7% for cards issued
outside the Schengen Area; such fees are non-refundable).
Upon receipt of the completed booking form and deposit payment, the Agency shall issue a booking confirmation.
The reservation shall only be deemed confirmed once all required documents and payments have been received.
The balance of the rental amount must be paid:
• No later than 30 days prior to the start of the rental period for villas, houses and apartments accommodating 6
persons or more;
• No later than 14 days prior to the start of the rental period for apartments accommodating up to 5 persons.
Exception: for MIPIM, FIF and LIONS events, full payment is required one month prior to the start of the rental
2. Security Deposit
The Client must validate the security deposit by credit card via the payment link sent by the Agency no later than
48 hours before check-in. The amount of the security deposit, as specified in each property listing, may not be
disputed by the Client.
For villas, an inventory and condition report carried out by a bailiff may be required at the Client’s expense, and
such requirement shall be specified in the listing.
3. Rental Price
The rental price includes the use of the furnished and fully equipped accommodation as described in the listing,
for the agreed rental period. Unless otherwise stated, water, electricity, gas, swimming pool maintenance and
garden maintenance are included.
In the event of excessive consumption of electricity or water inconsistent with reasonable use, additional charges
may be invoiced to the Client. Example: windows left open while air conditioning or heating is running.
The rental price does not include:
• Tourist tax, calculated according to the number of occupants;
• Final cleaning;
• Household and pool linen; and
• Any additional services requested by the Client.
All payments must be made in euros by bank transfer or credit card. Any bank charges shall be borne by the
4. Cancellation PolicyIn the event of cancellation, the deposit paid shall be refunded according to the following terms:
Villas, Houses and Apartments (capacity of 6 persons or more)
• More than 30 days before arrival: full refund of the deposit;
• More than 14 days before arrival: refund equal to 50% of the total rental amount;
• Less than 14 days before arrival: all sums paid shall remain due.
Apartments (capacity of fewer than 6 persons)
• More than 14 days before arrival: full refund of the deposit;
• More than 7 days before arrival: refund equal to 50% of the total rental amount;
• Less than 7 days before arrival: all sums paid shall remain due.
Exception: for all rentals in Cannes during MIPIM, FIF and LIONS events, bookings are firm and non-cancellable.
In the event of cancellation less than 60 days before arrival, all sums paid shall be retained by the Agency.
Specific agreements may also be concluded separately between the Agency and the Client.
5. Essential Conditions – Termination Clause
A) The maximum number of occupants must not exceed the number stated on the booking form.
Any presence of persons not included in the agreement, even for a short duration, must be declared to and
authorised in writing by the Agency in advance.
B) Noise disturbances, particularly between 11:00 p.m. and 7:00 a.m., or any other neighbourhood disturbance,
are strictly prohibited.
C) The accommodation is rented exclusively for tourist purposes and for a fixed duration. The Client may not
establish residency at the property.
D) The Client undertakes not to engage in any illegal, unlawful, immoral or commercial activity within the
accommodation and agrees to occupy the premises responsibly and with due care.
Any breach of the above provisions shall result in immediate termination of the agreement within 24 hours
following formal notice. The Client and all occupants shall vacate the premises without entitlement to

Rental Period
Apartments: check-in from 4:30 p.m. on the first day; check-out by 10:30 a.m. on the departure day.
Houses and Villas: check-in from 5:30 p.m. on the first day; check-out by 10:30 a.m. on the departure day.
The Client is not authorised to remain in the property after the stated departure time. Failing this, penalties may
apply in relation to any resulting loss suffered.
Return of the Security Deposit
Photos/videos of the condition of the accommodation shall be sent to the Client, who shall have 48 hours to raise
any objections. In the absence of any response, the condition report shall be deemed accepted.
The security deposit shall be released no later than one week after the end of the rental period, provided no
damage has been identified.
A video inventory and condition report shall be carried out by the Agency both on arrival and departure.
Early Check-In
If the Client requests early check-in, the property and furnishings shall be deemed to be in good condition and free
from any major defects.
Commercial Use
Use of the accommodation for commercial purposes is strictly prohibited, including publication of visual content on
platforms such as Instagram or TikTok.Smoking
Smoking inside the accommodation is strictly prohibited.
Final Cleaning
Final cleaning is included; however, the Agency reserves the right to retain part of the security deposit for
additional cleaning costs if the property is left in an unacceptable condition (€40 incl. VAT per hour, minimum
charge of 4 hours).
Maintenance and Repairs
The Client must immediately notify the Agency of any defect or equipment failure to enable prompt repair or
Liability
Neither the Agency nor the property owner shall be liable for accidents occurring on the property during the rental
period, including injury or death. The Client is strongly advised to take out insurance covering themselves and all
The Agency and the property owner shall not be liable to the Client for:
• Failures or interruptions of public utility services serving the property;
• Equipment malfunctions or disturbances arising from the surrounding environment;
• Losses, damages or inconvenience caused by weather conditions, strikes or other events beyond their control.
Improper use of furniture and household appliances may be dangerous; the Client and accompanying guests must
take all necessary precautions.
The Client shall be informed of any specific features of the property (retaining walls, level differences, swimming
pool, etc.) and shall use them under their own responsibility, as well as that of all other occupants.
Any exceptional amendment granted by the Agency for the benefit of the Client shall not alter these Terms and
Conditions. Should any clause be declared wholly or partially invalid, the remaining clauses shall remain fully
The agreement is executed in France and shall be governed exclusively by French law, with jurisdiction lying
exclusively with the French courts in the area where the property is located.
7. Modification or Cancellation by the Owner or the Agency
As holiday reservations may be made well in advance, unforeseen events may occur. In the unlikely event that the
owner or the Agency is required to modify or cancel a booking, the tenant shall be informed immediately.
The Agency shall make every effort to offer an alternative property of similar standard and price. The tenant may
either accept the alternative accommodation or cancel the booking, in which case a full refund shall be provided.
No further compensation or reimbursement of incurred expenses shall be payable.
8. Refusal of Access
The Agency reserves the right to refuse access to the rented property if all required conditions have not been fullfilled.
